Each manufacturer of a vapor product that is sold for retail sale in this state, whether directly or through an importer or other intermediary, must register each product in the Department’s vapor product directory. This is an annual certification that must be completed by August 1 each year to certify that the vapor products sold in this state continue to meet the requirements for inclusion in the vapor product directory. Manufacturers must register and certify each vapor product annually by filing a Vapor Product Directory Certification (Form TOB 560), which can be done through TNTAP.
The Department will publish the directory on its website beginning on January 1, 2026. The directory will be updated at least monthly. Beginning January 1, 2027, vapor products not listed in the directory cannot be sold for retail sale in this state. Vapor products not listed in the directory on or after January 1, 2027, will be subject to seizure, and sellers of unlisted vapor products will be subject to penalties.
